AN ORDINANCE OF WILKINSON COUNTY, GEORGIA TO PROHIBIT SMOKING IN PUBLIC COUNTY BUILDINGS AND COUNTY VEHICLES TO DEFINE THE AREAS IN WHICH SMOKING SHALL BE PROHIBITED, TO ESTABLISH FINES FOR VIOLATIONS OF THIS ORDINANCE, AND FOR OTHER PURPOSES
WHEREAS: The Board of Commissioners has determined that the smoking of tobacco in public buildings and in public vehicles constitutes a hazard to the health of employees and members of the public who may be exposed to such smoking activity; and
WHEREAS: The Board of Commissioners has determined that the smoking of tobacco in public buildings and in public vehicles should be prohibited;
NOW, THEREFORE, by virtue of the authority of Official Code of Georgia 369 § 36-9-2 and Official Code of Georgia § 16-12-2; it is hereby ordained by virtue of same, the following smoking ban in public buildings and public vehicles in Wilkinson County, Georgia.
SECTION 1. DEFINITIONS.
As used in this Ordinance, the following terms shall have the respective meanings ascribed to them:
County facilities; county buildings: All facilities or buildings owned, rented or occupied by the county and its officers, agents and employees.
County vehicles and equipment: any vehicle or equipment owned or leased by the county and operated by county employees, officers or agents, including cars, trucks and road department equipment which is equipped with an enclosed cab.
Smoke or smoking: Any act of burning any tobacco product of any kind in a cigarette, cigar or pipe.
SECTION 2. PURPOSE.
This Ordinance has been enacted and is designed to protect the public health and welfare by prohibiting smoking in public places, places of employment and county vehicles, except in designated smoking areas; to strike a balance between the needs of smokers and non-smokers; and to recognize that when a conflict exists, the need to breathe smoke-free air shall have priority.
SECTION 3. RESTRICTED AREAS.
No person shall smoke in any of the following facilities or vehicles of the county:
(1) Elevators; (2) Restrooms; (3) Reception areas and lounges; (4) Waiting rooms and hallways; (5) Employee work areas; (6) Cafeterias and snack bars; (7) Auditoriums, conference and meeting rooms, public assembly areas and chambers; (8) Vehicles, trucks and equipment with enclosed passenger and/or operator cabs.
SECTION 4. PERMITTED AREAS.
Smoking will be permitted in designated smoking areas only. Each department head, official or other appropriate person, shall designate smoking areas to reasonably accommodate both smokers and non-smokers; however, it is not the intent of this section to incur any expenses to make structural or physical modifications of any area to accommodate smokers. Further, designated smoking areas shall not be located in any of the areas defined in Section 3 above.
SECTION 5. DESIGNATED AREAS.
"No Smoking" signs shall be placed clearly and conspicuously in all elevators, hallways, restrooms and public meeting places and in other restricted areas defined in Section 3 above, in addition to the general prohibition of smoking as outlined in this Ordinance.
SECTION 6. ENFORCEMENT.
This Ordinance shall be enforced by any authorized law enforcement officer of the county.
SECTION 7. PENALTY.
Any person violating any provision of this article shall be punished by a fine of not less than $10.00, nor more than $100.00, within the discretion of the presiding judge. Jurisdiction of cases for the violation of this Ordinance shall be in the Magistrate Court of Wilkinson County, Georgia.
SECTION 8. REPEALER CLAUSE.
All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed.
SECTION 9. EFFECTIVE DATE.
This Ordinance shall become effective on the 19th day of January 1999 by the Wilkinson County Board of Commissioners.
