AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF WILKINSON COUNTY, GEORGIA, REGULATING THE LENGTH OF TIME A TRAIN WHICH IS NOT MOVING CAN BLOCK A RAILROAD CROSSING LOCATED UPON A COUNTY ROAD.

PURSUANT TO THE AUTHORITY CONTAINED IN ACT OF FEB. 28, 1933, NO. 79, SEC. 6, 1933 GA. LAWS 777, AND PURSUANT TO ARTICLE 9, SECTION 2, PARAGRAPH 13 OF THE CONSTITUTION OF THE STATE OF GEORGIA, THE BOARD OF COMMISSIONERS OF WILKINSON COUNTY, GEORGIA, HEREBY DETERMINES THAT IT IS IN THE PUBLIC INTEREST OF THE CITIZENS OF WILKINSON COUNTY TO LIMIT THE LENGTH OF TIME A TRAIN WHICH IS NOT MOVING CAN BLOCK A RAILROAD CROSSING LOCATED UPON A COUNTY ROAD.

BE IT ORDAINED, BY THE BOARD OF COMMISSIONERS OF WILKINSON COUNTY, GEORGIA, AND THE BOARD OF COMMISSIONERS OF WILKINSON COUNTY, GEORGIA, HEREBY ORDAINS BY AUTHORITY OF SAME, THAT:

SECTION 1: RAILROAD CROSSINGS It is unlawful for any train which is not in motion to block any of the railroad crossings located upon a county road for more than five (5) minutes.

SECTION 2: JURISDICTION OF MAGISTRATE COURT FOR VIOLATIONS. The Magistrate Court of Wilkinson County, Georgia shall have jurisdiction for the disposition of any violations of this ordinance, pursuant to O.C.G.A. sec. 15-10-2. Any person or firm who is found guilty of a violation of this ordinance shall be subject to a fine of not less than $25.00, nor more than $100.00, within the discretion of the Judge of the Magistrate Court.

SECTION 3: INVALIDITY OR UNCONSTITUTIONALITY If any portion of this ordinance shall be held to be invalid or unconstitutional, such invalidity or unconstitutional, such invalidity or unconstitutionality shall not affect or impair the remaining portions unless it clearly appears that such other parts are wholly and necessarily dependent upon the part held to be invalid or unconstitutional.

SECTION 4. REPEALER CLAUSE All ordinances or resolutions or parts thereof in conflict herewith are hereby repealed.

SECTION 5: RENUMBERING OR RELETTERING OF CODE OF ORDINANCE It is the intention of the board of commissioners of Wilkinson County and it is enacted that the provisions of this ordinance shall become and be made a part of the code of ordinances of the Wilkinson County Commissioners, and that sections of this ordinance be renumbered or relettered to accomplish such intention.

SECTION 6: EFFECTIVE DATE. This ordinance shall take effect upon its adoption.
